Terms of service

The following Terms and Conditions (the "Terms") govern the use of the website www.sunshineliving.dk (the "Website") and any offer and sale of products on the Website. The Website is owned and operated by SunshineLiving.dk ApS, Company (CVR) No. 42782343 (hereinafter: "we", "us", or "our"). Any customer (hereinafter: "you" or "your") is advised to read the Terms carefully, including before placing an order at the Website.

Please note that the Terms may be subject to changes, including to reflect the latest products available at the Website.

 

  1. Orders

1.1 Binding Agreement: By placing an order, you accept our Terms, and a legally binding agreement is entered into between you and us. Once an order is in our system, we cannot guarantee changes can be made – however, our customer service is always willing to assist. You will receive an order confirmation by e-mail shortly after your order is completed (remember to check your spam-filter).

1.2 Single product: At the Website, we offer "Home Boxes" and other boxes/bundles of items, the content of which you can either select yourself or which has been pre-selected. The Rollor packaging used to contain the individual items has been specifically designed so as to be used for other applications by you than simply transporting items, and so the Rollor packaging has independent value. It follows from this that a "Home Box" and all other boxes/bundle of items, including all contents and the Rollor packaging used, constitute a single product sold to you.

1.3 Order handling: All items are carefully inspected, prepared, and dispatched from our headquarter address (see section 10 below). Your order is packed in our specifically designed Rollor packing. We dispatch orders every Wednesday. Orders placed by Tuesday 12.00 CE(S)T will be processed and dispatched the following business day, i.e. on Wednesday. Orders placed after Tuesday 12.00 CE(S)T will be dispatched the following Wednesday.

1.4 Items out of stock and discrepancies: If your order consists of items that are out of stock, we reserve the right to await processing and dispatch until all items are in stock. If you wish to receive items sooner in separate deliveries, additional delivery charges may apply. We reserve the right not to deliver in the event that the product information, stock level or price was incorrect at the time of order placement. However, we always strive to have accurate information online at any given time. In the event of cancellation or changes to your order, you will be contacted by our customer service. In case of force majeure, we cannot be held responsible for delay or failure to meet our order obligations.

 

  1. Delivery

2.1 General: We offer shipping to the countries specified on the Website, and you are always welcome to contact our customer service in this respect. All products are shipped from Denmark and will be delivered to the address specified on the order. For deliveries within Denmark, we deliver to residential or company addresses or to parcel shops. For deliveries outside Denmark, we only deliver to parcel shops. Orders are generally shipped with GLS (www.gls.dk) or Postnord (www.postnord.dk) and are subject to the terms of these third parties (see https://gls-group.eu/DK/en/terms-conditions and https://www.postnord.dk/kundeservice/kundeservice/forretningsbetingelser). We reserve the right to use an alternative courier service. The parcel must be signed for upon receipt. Everyone at the addresses can sign for you, but be careful as it is with legally binding effect on you.

2.2 Shipping costs: All shipping costs are paid and payable by you, and we collect payment from you in connection with order placement. We will in turn pay the courier.

2.3 Delivery time: From the time of dispatchment (see section 1.3 above), the delivery times are estimated as follows:

- Denmark: 1-3 business days
- Europe: 3-7 business days

2.4 Track and trace: All our shipments will be available with a tracking number provided by the courier. Once your order has been dispatched and it has been registered by our courier, you will receive a track and trace number by e-mail (remember to check your spam-filter) or by SMS. You are always welcome to contact customer service for an update on your order.

 

  1. Payment

3.1 Payment methods: We accept a wide variety of payment methods (and will strive to add even more). We accept the following payment methods:

- PayPal

If you are experiencing any issues with our online payment, please do not hesitate to reach out to our customer service.

3.2 Payment standards: The Website uses customary technological protective standards to minimise risk of fraud. If you are suspicious or aware of fraud linked to the use of your card (especially on our Website), please contact our customer service immediately as well as your bank and/or credit card company.

3.3 Prices & currencies: All orders are quoted and charged in Danske Kroner (DKK) and include Danish Value Added Tax (VAT) of 25%, including for deliveries outside Denmark. Delivery costs are always specified separately (see section 2.2 above). We reserve the right to change our prices with immediate effect and without prior notice.

 

  1. Returns & claims 

4.1 Returns: All Home Boxes, other bundles of items, as well as individual items sold at the Website can be returned for a full refund within 14 days of your receipt thereof. Returns can only be made if the relevant items are unused and in original condition (e.g. they have not been opened, including by removal of the seal, or damaged in any way). Upon contacting our customer service and providing sufficient proof of purchase and condition of items (please provide order number and photos of the items in question), you will receive a return label with the return cost paid by us. While the returned parcel is in transit, it is under your responsibility. Therefore, we always advice using a courier with a traceable (and ideally insured) service. Please make sure to fill out the enclosed return form and send everything to the address stated in section 10 below.

4.2 Refunds: Once we receive your return in the conditioned specified in section 4.1 above, your refund of the product price will automatically be processed, and the total price of the item(s) will be transferred back to the card (and linked account) that made the purchase. Normally, it takes a few business days for the refund to go through, however, for international credit cards, this process can be prolonged. Please do not hesitate to contact customer service to get an update on your return/refund.

4.3 Non-conforming items: If your one or more of the items delivered in the "Home Box" or other box/bundle of items are non-conforming, i.e. is damaged or is a wrong item, please contact our customer service. If your inquiry is approved by our customer service, we will send you a return label with the return cost paid by us. You will then be able to choose between exchanging it for (a) similar item(s) or receive a full refund for the item(s) in question. We reserve the right to charge you for the extra Rollor Packaging to be used for delivering replacement items. Claims arising from items being damaged in transit must be notified to our customer service within seven (7) business days of receiving the parcel. Please provide order number and photos of the damaged item(s). You might be asked to return the product to us for examination. If that is the case the shipping expenses are covered by us.

4.5 Complaints: In case you wish to complain about products purchased from us, please contact our customer service by email (see section 10 below). In case, you are unsatisfied with our handling of your complaint, you can file a complaint with the Danish Competition and Consumer Authority (www.forbrug.dk). You can also contact Online Dispute Resolution provided by the European Commission. This is relevant for customers within the EU. You can file your complaint at http://ec.europa.eu/odr. When filing your complaint, you must state our customer service email (see section 10 below).

 

  1. Disclaimer of liability

5.1 Distribution: We do not manufacture any of the products displayed and offered for sale at the Website; the products offered for sale at the Website have been purchased by us either from the manufacturers or other vendors. Users are advised to seek further information from the relevant manufacturers (or vendors) about the products sold and offered for sale at the Website.

5.2 Information on the Website: At the Website, we provide general information about health and potential health benefits of the products (and individual items) we sell. In particular, this includes information about heavy metals, toxins and environmental issues as well as the (non-)toxicity of items sold. All users and customers are specifically advised that we are not doctors or other kind of health professionals, and we are not offering health advice or services in any way. The information provided at the Website is based only on our own research and personal experience, and all customers are advised to carry out their own research, including to fact-check information provided at the Website.

5.3 Products and product information: At the Website, we also provide specific (health) information related to the individual products and items offered. In particular, this includes information about the level of toxicity and appropriate application of the items on offer. Such information is also solely based on our own research and personal experience, and all customers are advised to carry out their own research, including to fact-check information provided at the Website, as well as checking the relevant websites of the product manufacturers in question and other related information originating from the manufacturers.

5.4 Disclaimer of liability: We disclaim any and all liability vis-à-vis all users of the Website and our customers with respect to the information provided at the Website (whether general information or information related to individual products or items), including any liability that could potentially arise as a consequence of any users or customers using or relying on the information provided at the Website leading to any personal damage or injury to users, customers, family members and acquaintances etc. We further disclaim any and all potential liability for your use (or misuse) of the products purchased at the Website, including - but not limited to - personal injury or damage to property or general economic damage. In general, we disclaim all product liability to the furthest extent possible under applicable law, referring, i.a., to the fact that we are not manufacturers of the products sold or offered for sale at the Website.

 

  1. Intellectual property rights

6.1 The "Sunshine Living" name, logo and brand are the sole property - and with respect to the name and logo also the registered trademark - of SunshineLiving.dk ApS and may not be used in any way by you or any third party without prior written consent from us. You may use the information to the extent necessary to process your purchases on the Website. You may link to the Website on social media platforms within the framework of applicable laws.

6.2 Our Instagram profile (@sunshineliving.dk) is also owned by SunshineLiving.dk ApS. You may link to the Website on social media platforms within the framework of applicable laws.

6.3 Links provided at the Website to third party manufacturers and vendors are made only for informative purposes to you, and we have no control over such third-party manufacturers or vendors or their respective websites. Thus, we assume no responsibility or liability in these respects.

 

  1. Language

7.1 The Website is in English and all advertisements made by us for the Website have been made in English, including on the Sunshine Living Instagram profiles. On this basis and by using the Website, you accept to be provided necessary information under applicable laws in English.

7.2 Our customer service can communicate with you in English, Danish or German, with English being the default language used for such purposes.

 

  1. Personal data & cookies

8.1 Personal data: We treat all your personal data with utmost confidentiality. Please read our Privacy Policy that explains how we use the personal data with your consent and in compliance with GDPR.

8.2 Cookies: We use cookies at the Website. A cookie is a small text file which is stored in your web browser and which registers you as a unique user. Read more about our use of cookies in our Privacy Policy.

 

  1. Governing law and disputes

9.1 The Terms and any offer and sale of products on the Website as well as any disputes arising therefrom are governed by the laws of Denmark (excluding Danish choice of law rules).

9.2 Any dispute arising out of or in connection with the Terms or any offer or sale of products on the Website, including any disputes regarding the validity or interpretation of the Terms, or the existence, validity or termination of any sale, shall be finally settled by the District Court of Copenhagen (in Danish: Københavns Byret) having exclusive jurisdiction.
